Here is the thing: under UU No. 1 Tahun 2023 (KUHP Nasional), Pasal 433, criminal defamation only protects individual human beings. A corporation cannot be the victim of criminal defamation. Full stop. The Mahkamah Konstitusi confirmed this in Putusan No. 105/PUU-XXil/2024, barring companies from filing defamation complaints entirely. So what exactly are they threatening me with? You cannot criminally defame a company under Indonesian law as it currently stands. The threat has no legal foundation. What makes this more telling is how it happened. There was no lawyer in the room. No legal counsel present on their side. Just the country manager and the HRBP , Salsabila Meidiana Putri delivering what they framed as a mercy, a concession, a kindness extended to me. Now, i'm questioning if they have a legal team in hand. That framing alone says everything. When a legal threat is delivered without a lawyer, by someone who is not trained in law, itis not professionalism. It is noise dressed up as authority. A verdict issued by someone without jurisdiction over the subject they are pronouncing on. Ido not say this with bitterness. | say it as someone who has read the statute. If you are going to warn a former employee about defamation law, bring someone who knows what defamation law says. Otherwise you are not protecting your company. You are exposing how little your process trusts its own foundations. To any professional in Indonesia who has faced a similar situation: know that a company threatening you with criminal defamation has no standing to do so under the current legal framework.
