aah | just completed a cross-border legal judgment analysis on a case involving Indonesian expats in Japan who cyberbullied me online. Aria Ghora Prabono ‘Adith Widya Pradipta Mustafa Zaki Assegaf Marcello Faria Here is what it revealed. The Facts Four Indonesian nationals living in Japan participated in a coordinated cyberbullying campaign against me on Twitter/x following my dismissal from AWS Indonesia in September 2023. The attacks included public dehumanization, coordinated harassment, and deliberate targeting during my mental health recovery. Why Indonesian Courts Have Full Jurisdiction Even though the perpetrators were physically in Japan, Indonesian law applies on two separate grounds: KUHP Article 4(c) (Effects Doctrine) the harm was felt in Indonesia KUHP Article 8 (Active Nationality Principle) they are Indonesian citizens The double criminality requirement is also satisfied because Japan criminalizes defamation and insult under Filiz (Keind) Article 230 and 231. Verdict Probability: 90% chance of meaningful legal consequence 10% Light outcome (mediation, apology) 45% Moderate outcome (suspended sentence, fines up to Rp 1 billion, civil damages up to Rp 2 billion) 45% Heavy outcome (active imprisonment + fines + public apology + damages up to Rp 5 billion) The Dual-Track Strategy Indonesia: File with Subdit Cybercrime Polda Metro Jaya, request DPO (arrest warrant) + immigration travel ban. When they land in Indonesia, they get arrested. Japan: File a formal 3 (kokuso) complaint via KBRI Tokyo and a Japanese criminal lawyer. Japanese courts can compel ‘Twitter/X Japan to disclose identity and IP data under {#38 aA. Parallel prosecution in both countries is legal under KUHP Article 135. The Lesson Indonesian citizenship does not come with immunity. Indonesian law follows its citizens abroad. If you cyberbully someone in Indonesia white living in Japan, you are still subject to Indonesian criminal law plus Japanese criminal law simultaneously. Documentation matters. Screenshots, timestamps, archived URLs, and medical records are all evidence. 1am building this case one legal analysis at a time. Every defendant gets a verdict report.
